В Бразилии электронные сигареты классифицируются как табачные изделия. В соответствии с резолюцией RDC № 46 (2009) запрещены продажа, реклама, распространение и импорт любых электронных курительных устройств, а также аксессуаров и запасных картриджей к ним. Как табачные изделия, их использование в общественных местах и на общественном транспорте запрещено согласно декрету № 2.018 (1996).
