W Brazylii e-papierosy są klasyfikowane jako wyroby tytoniowe. Zgodnie z Rezolucją RDC nr 46 z 2009 roku, sprzedaż, reklama, dystrybucja oraz import jakichkolwiek elektronicznych urządzeń do palenia, akcesoriów lub wkładów są zabronione. Jako wyroby tytoniowe, ich używanie w miejscach publicznych oraz w środkach transportu publicznego jest zakazane na mocy Dekretu nr 2.018 z 1996 roku.
