W Austrii e-papierosy są legalne i objęte określonymi przepisami. Zgodnie z tymi regulacjami sprzedaż e-papierosów i płynów z nikotyną jest dozwolona i produkty te są dostępne w ogólnodostępnych punktach sprzedaży, jednak zakup przez internet jest zabroniony. Wymagane są obowiązkowe zgłoszenia nowych produktów, opakowania muszą być zabezpieczone przed dziećmi oraz oznakowane ostrzeżeniami zdrowotnymi. Minimalny wiek uprawniający do zakupu e-papierosów to 18 lat. Obowiązują także ograniczenia dotyczące zawartości nikotyny i pojemności zbiorników, a korzystanie z e-papierosów jest prawnie ograniczone w wybranych miejscach publicznych. Nie ma jednak ograniczeń dotyczących smaków, a stosowanie oświadczeń zdrowotnych jest zabronione. Na produkty z e-papierosami nie jest również nakładana akcyza. Jeśli chodzi o rozpowszechnienie, w 2023 roku w Austrii szacowano, że liczba osób aktualnie używających e-papierosów wynosiła 307 000. Odsetek dorosłych obecnie korzystających z e-papierosów wynosił 4%, przy czym wśród mężczyzn było to 4,5%, a wśród kobiet 2,2% (na podstawie danych z 2020 roku). Szacuje się, że w 2025 roku odsetek dorosłych codziennie używających e-papierosów będzie wynosił 0,9%, z czego 1,3% wśród mężczyzn oraz 0,5% wśród kobiet. W badaniu przeprowadzonym w 2017 roku 21% dorosłych zadeklarowało, że kiedykolwiek próbowało e-papierosów.
