Los cigarrillos electrónicos se denominan Sistemas Electrónicos de Administración de Nicotina (SEAN) en un decreto (N.º 37185-S-MEIC-MTSS-MP-H-SP) de 2012 y se clasifican como productos de tabaco. Su venta está permitida conforme a la Ley de Control de Tabaco (N.º 9028, 2012). Se prohíbe cualquier forma de publicidad, promoción o patrocinio fuera de lugares o eventos exclusivos para adultos o de comunicaciones directas. Está prohibido el uso de productos que contienen nicotina en espacios públicos cerrados y en el transporte público. Los productos sin nicotina están regulados por el Registro de Productos Peligrosos, aunque su comercialización no está regulada.
