In Spain, smoking is legally allowed but tobacco is subject to strict regulations. Cigarettes are regulated under national law and are legally permitted for sale and smoke; however, there is a ban on all forms of their advertising, promotion, and sponsorship. Cigarettes cannot be purchased online and are restricted to licensed tobacco shops and authorised vending machines. Additionally, health warnings on packaging are required, and the minimum legal age for purchase is 18 years. Smoking is prohibited in all enclosed public places and workplaces. Cigarettes in Spain are subject to an excise tax rate of 9.23% and a total taxation rate of 77.59%.

Despite these control measures, smoking remains a public health concern in Spain. In 2024, there were approximately 10 million current smokers among adults aged 15 years and older in the country, representing an adult current smoking prevalence of 24.1%. This shows a sight decrease from 24.9% in 2022. Smoking prevalence was substantially higher among males (26.9%) than among females (21.3%) in 2024. In 2021, smoking led to approximately 45,137 deaths in Spain, including 38,172 deaths among males and 6,965 among females. Overall, smoking consisted 10.13% of all deaths in the country, including 16.72% of male deaths and 3.21% of female deaths.
