E-cigarettes are legal in Belgium under a specific regulatory framework. They are legal to sell and use, but online sales are prohibited. While health claims are permitted, there is a ban on all advertising. E-cigarettes are available in general retail outlets, and there is no excise tax applied to these products. Regulations require notifications of new products, child- and tamperproof packaging, and health warnings on packaging. Additionally, sales are restricted to individuals aged 18 years and older, and there are legal restrictions on use in public places. The nicotine content is limited to 20 mg/mL or less, and tank sizes must not exceed 2 mL. However, there are no restrictions on flavour range.
In terms of prevalence, there were approximately 383,900 current vapers in Belgium in 2023. This represents an adult current e-cigarette vaping prevalence of 4%. The prevalence was higher among men (12%) compared to women (8%). In the same year, the adult daily vaping prevalence was 1.2% overall. In 2021, this was 3% among both men and women. Fo reference, in 2017, 16% of adults reported having ever tried e-cigarette vaping. A survery conducted in 2017 showed that 62% of respondents in Belgium believed that e-cigarettes are harmful or more harmful than cigarettes, 34% thought they were not harmful or less harmful, and 4% were unsure.
