W Stanach Zjednoczonych zasady dotyczące e-papierosów różnią się w zależności od stanu. Ogólnie rzecz biorąc, zgodnie z przepisami federalnymi, produkty te są dozwolone i regulowane jako wyroby tytoniowe. Przepisy obejmują wymogi dotyczące opakowań zabezpieczonych przed dziećmi i manipulacją oraz obowiązek umieszczania ostrzeżeń zdrowotnych na opakowaniach. Na każdym opakowaniu e-papierosów musi się znaleźć informacja: „OSTRZEŻENIE: Ten produkt zawiera nikotynę. Nikotyna jest substancją silnie uzależniającą.” Na poziomie federalnym nie istnieje minimalny wiek zakupu tych produktów, jednak wiele stanów samodzielnie określa takie limity, najczęściej wynoszące 21 lat. Statystyki pokazują, że używanie e-papierosów jest w USA powszechne. W 2020 roku szacowano, że liczba osób aktualnie używających e-papierosów wynosiła 9,1 miliona. W 2021 roku odsetek dorosłych aktualnie korzystających z e-papierosów oszacowano na 4,5% (kobiety – 4%, mężczyźni – 5,1%). Około 4,3 miliona osób korzystało z e-papierosów codziennie w 2020 roku, a odsetek dorosłych codziennych użytkowników wynosił 1,33%. Regularne codzienne stosowanie e-papierosów było nieco częstsze wśród mężczyzn (1,74%) niż kobiet (0,99%). Ogółem 17% mieszkańców USA zadeklarowało, że kiedykolwiek próbowało e-papierosa w 2020 roku. Społeczne postrzeganie szkodliwości e-papierosów jest zróżnicowane – w 2017 roku 36,4% dorosłych uważało, że e-papierosy są równie szkodliwe jak tradycyjne papierosy, 33,9% uznawało je za mniej szkodliwe, 4,3% za bardziej szkodliwe, a 25,3% nie miało na ten temat zdania.
