Sytuacja prawna dotycząca e-papierosów na Tajwanie jest niejasna, a obecnie funkcjonują one dzięki luki prawnej. Zgodnie z obowiązującym prawem, sprzedawcy powinni posiadać zezwolenie zgodnie z ustawą o produktach farmaceutycznych, jednak żadne takie zezwolenie nie zostało wydane. Tajwan posiada ustawę o zapobieganiu szkodom wynikającym z używania tytoniu z 1997 roku, jednak nie obejmuje ona e-papierosów, ponieważ nie zawierają one tytoniu. W 2017 roku informowano, że Rada Wykonawcza (Executive Yuan), czyli organ wykonawczy rządu Tajwanu, rozważała nowelizację tej ustawy, która przewidywałaby całkowity zakaz sprzedaży wszelkich produktów do wapowania, niezależnie od tego, czy zawierają nikotynę, czy nie. Nowe przepisy miałyby sformalizować ten zakaz oraz wprowadzić surowe kary za jego łamanie. Produkcja lub import e-papierosów byłby zagrożony grzywną od 50 000 do 250 000 dolarów tajwańskich (NT$), co odpowiada 1650–8250 dolarom amerykańskim. Sprzedaż oraz używanie e-papierosów w miejscach objętych zakazem palenia skutkowałoby karą grzywny w wysokości od 10 000 do 50 000 NT$ (330–1650 USD).
