La situación legal en Taiwán es confusa y los cigarrillos electrónicos existen actualmente gracias a un vacío legal. Oficialmente, los comercios necesitan una licencia según la Ley de Asuntos Farmacéuticos para vender cigarrillos electrónicos, pero ninguna ha sido aprobada. Taiwán cuenta con una Ley para la Prevención de los Daños del Tabaco (1997), pero al parecer esta no puede regular los cigarrillos electrónicos, ya que no contienen tabaco. En 2017 se informó que el Ejecutivo de Taiwán, el Yuan Ejecutivo, estaba considerando una enmienda a la Ley para la Prevención de los Daños del Tabaco que resultaría en la prohibición total de la venta de todos los productos de vapeo, contengan nicotina o no. La nueva ley consolidaría la prohibición e impondría sanciones severas por su incumplimiento. La pena por fabricar o importar cigarrillos electrónicos iría de NT$50,000 a NT$250,000 (entre 1,650 y 8,250 dólares estadounidenses). La venta y el uso de productos de cigarrillos electrónicos en áreas donde está prohibido fumar serían sancionados con una multa de NT$10,000 a NT$50,000 (de 330 a 1,650 dólares estadounidenses).
