W 2018 roku decyzja sądu okręgowego w Nowej Zelandii zezwoliła na sprzedaż podgrzewanych wyrobów tytoniowych na mocy ustawy Smokefree Environments z 1990 roku. Sprawa dotyczyła firmy Philip Morris International (producenta IQOS) przeciwko Ministerstwu Zdrowia Nowej Zelandii. Obowiązujące przepisy stanowią, że podgrzewane wyroby tytoniowe nie mogą być sprzedawane ani reklamowane osobom niepełnoletnim (poniżej 18 lat). Ministerstwo Zdrowia Nowej Zelandii zapowiedziało, że zamierza opracować system regulacji proporcjonalny do poziomu ryzyka dla produktów objętych ustawą Smokefree Environments z 1990 roku, w tym podgrzewanych wyrobów tytoniowych.
