En 2018, una decisión de un tribunal de distrito de Nueva Zelanda permitió la venta de productos de tabaco calentado bajo la Ley de Entornos Libres de Humo de 1990. El caso fue Philip Morris International (fabricante de IQOS) contra el Ministerio de Salud de Nueva Zelanda. La legislación que regula los productos de tabaco calentado establece que no deben venderse ni promocionarse a menores de 18 años. El Ministerio de Salud de Nueva Zelanda ha declarado que prevé desarrollar un marco regulatorio proporcional al riesgo para los productos incluidos en la Ley de Entornos Libres de Humo de 1990, lo cual abarca a los productos de tabaco calentado.
