Papierosy elektroniczne są legalne w Nowej Zelandii i podlegają przepisom dotyczącym bezpieczeństwa produktów, opakowań oraz sprzedaży. Zgodnie z tymi regulacjami, nowe produkty muszą być zgłoszone przed wprowadzeniem na rynek, a pojemniki powinny być zabezpieczone przed otwarciem przez dzieci. Na opakowaniach wymagane są ostrzeżenia zdrowotne, a sprzedaż dozwolona jest wyłącznie osobom, które ukończyły 18 lat. Obowiązują też limity zawartości nikotyny (maksymalnie 20 mg/ml), jednak nie ma ograniczeń co do dostępnych smaków. Używanie e-papierosów w miejscach publicznych jest również uregulowane. Produkty te można legalnie kupować przez internet oraz w zwykłych punktach sprzedaży detalicznej. Dozwolone jest prezentowanie twierdzeń zdrowotnych dotyczących e-papierosów, a obecnie nie jest nakładany na nie podatek akcyzowy. W 2021 roku szacowano, że w Nowej Zelandii było 316 500 osób aktualnie używających e-papierosów. W 2023 roku częstość użytkowania e-papierosów wśród dorosłych wynosiła szacunkowo 11,9%, przy czym wśród kobiet było to 7%, a wśród mężczyzn 9,5%. Liczba osób codziennie używających e-papierosów wynosiła 239 300, a odsetek dorosłych codziennych użytkowników – 6,2% (w tym 5% kobiet i 7,5% mężczyzn). W przeprowadzonym w 2021 roku badaniu 25,2% respondentów zadeklarowało, że próbowało kiedykolwiek użyć e-papierosa.
