E-papierosy są legalne do użytku i sprzedaży w Mołdawii. Urządzenia zawierające nikotynę podlegają regulacjom ustawy nr 278 o kontroli wyrobów tytoniowych (z późniejszymi zmianami). Chociaż Mołdawia nie należy do Unii Europejskiej, przepisy te w wielu aspektach są zbliżone do unijnej dyrektywy w sprawie wyrobów tytoniowych (TPD) z 2014 roku. Zabroniona jest sprzedaż transgraniczna na odległość, sprzedaż przez internet oraz handel prowadzony na ulicy. Obowiązują ograniczenia dotyczące lokalizacji punktów sprzedaży detalicznej w pobliżu placówek oświatowych i medycznych. Przepis zakazujący eksponowania produktów związanych z wyrobami tytoniowymi, w tym e-papierosów, w przestrzeniach handlowych, a jednocześnie nakazujący sprzedawcom udostępnienie wykazu oferowanych produktów, ma wejść w życie w maju 2020 roku. Używanie e-papierosów jest zabronione w miejscach, gdzie obowiązuje zakaz palenia tradycyjnych wyrobów tytoniowych, w tym także w prywatnych pojazdach, jeżeli przebywają w nich osoby poniżej 18. roku życia.
