Fumar es legal en Niue bajo ciertas restricciones y está regulado como producto de tabaco. La venta de cigarrillos es permitida, incluso a través de máquinas expendedoras y en línea, aunque su comercialización está sujeta a limitaciones. La edad mínima legal para la venta de cigarrillos es de 21 años. Los productos de cigarrillos se comercializan en Niue, pero toda su publicidad está prohibida. Además, se exige que los envases de cigarrillos incluyan advertencias sanitarias y se permite la importación de cigarrillos para su comercialización siempre que se cuente con la licencia de importación correspondiente. En 2021, el tabaquismo fue responsable del 11,47% de todas las muertes, atribuyéndose al consumo de tabaco el 16,69% de los fallecimientos masculinos y el 5,89% de los femeninos.
