E-cigarettes are legal in Poland and subject to comprehensive regulations. Based on these regulations, sales of e-cigarettes to minors under 18 are prohibited, and product notification, child-resistant packaging, and health warnings on packaging are all required. There are no restrictions on flavours, but nicotine content is limited to 20 mg/mL, and tank size limits are in place. The use of e-cigarettes in public places is also restricted under existing laws. E-cigarettes can be purchased online and through general retail outlets, though sales via vending machines are not permitted. Health claims are not allowed, and there is a complete ban on advertising. An excise tax applies to e-cigarettes which amounts to 10 % of that applied to traditional cigarettes.
In 2023, Poland recorded an estimated 1.3 million current vapers, and reported that the adult current e-cigarette vaping prevalence was 4 %. The adult daily vaping prevalence was 2.4 % in the same year. Among males, it was recorded to be 0.4% and among males it was 1.5%. For reference, 13 % of people in 2017 reported having ever tried vaping. In terms of perceptions of risk by e-cigarettes, in 2017, 56 % of people believed e-cigarettes were as harmful or more harmful than smoking, 28 % thought they were less harmful, and 16 % had no idea about it.
