In 2019, India enacted the Prohibition of Electronic Cigarettes Act, 2019 which banned a broad category of Electronic Nicotine Delivery Systems (ENDS) including electronic cigarettes, vaping devices, and Heat Not Burn (HNB) products. The Act to prohibit the production, manufacture, import, export, transport, sale, distribution, storage and advertisement. There are no restrictions on the use of e-cigarettes.
E-cigarette sales allowed except in 7 states - Bihar, Kerala, Karnataka, Punjab, Mizoram, Jamma & Kashmir where ENDS are banned. Delhi & Maharashtra were also considering a ban. However recent advice from the Government Ministry of Welfare & Families issued in August 2018, advised all states to prohibit sales, import and advertisement of ecigarettes.
