W Rumunii ustawa 201/2016 wdraża artykuł 19 unijnej Dyrektywy tytoniowej, obejmujący nowe wyroby tytoniowe i odnoszący się również do podgrzewanych wyrobów tytoniowych. Przepisy regulują kwestie sprawozdawczości, zgłoszeń oraz wymogi dotyczące umieszczania ostrzeżeń zdrowotnych. Kodeks podatkowy klasyfikuje podgrzewane wyroby tytoniowe jako produkty objęte tzw. „akcyzą niezharmonizowaną” (Tytuł VIII), co określa strukturę obowiązujących podatków.
