Papierosy elektroniczne zawierające nikotynę są uznawane za wyroby tytoniowe i zostały objęte przepisami dotyczącymi tego typu produktów. Do dystrybucji, eksportu, importu lub produkcji e-papierosów wymagane jest posiadanie licencji wydanej przez Ministra Finansów. Sprzedaż przez osoby niepełnoletnie oraz sprzedaż osobom poniżej 21. roku życia są zakazane, a przy sprzedaży obowiązuje weryfikacja wieku. Zabroniona jest sprzedaż za pośrednictwem automatów oraz sprzedaż transgraniczna na odległość przez internet lub zamówienia pocztowe. Reklama, promocja, sponsoring, ekspozycja wyrobów tytoniowych w punktach sprzedaży oraz tzw. „brand-stretching” są całkowicie zakazane.
