W Japonii podgrzewane wyroby tytoniowe są objęte regulacjami wynikającymi ze znowelizowanej Ustawy o Promocji Zdrowia. Nowelizacja tej ustawy rozszerza definicję palenia na dym lub parę powstałą w wyniku spalania lub podgrzewania tytoniu, w związku z czym podgrzewane wyroby tytoniowe zostały włączone do zakazu palenia przewidzianego w nowych przepisach. Palenie jest całkowicie zabronione w szkołach, szpitalach, placówkach dziecięcych, budynkach administracji rządowej, samochodach osobowych oraz samolotach. Jednak w praktyce korzystanie z podgrzewanych wyrobów tytoniowych jest dozwolone w innych miejscach publicznych, takich jak restauracje, statki pasażerskie oraz pociągi. Podatek nałożony na podgrzewane wyroby tytoniowe jest obecnie ustalony na tym samym poziomie co dla tytoniu fajkowego, zgodnie z Ustawą o podatku tytoniowym, a sprzedaż nieletnim jest ograniczona zgodnie z artykułem 5 Ustawy o zakazie palenia tytoniu przez nieletnich. Podgrzewane wyroby tytoniowe podlegają również regulacjom wynikającym z Ustawy o przemyśle tytoniowym.
