En Japón, los productos de tabaco calentado están regulados por la Ley de Promoción de la Salud modificada. Las reformas a esta ley definen fumar como la exposición al humo o vapor procedente del tabaco quemado o calentado, por lo que los productos de tabaco calentado quedan incluidos en la prohibición de fumar establecida por dichas reformas. Fumar está completamente prohibido en escuelas, hospitales, instalaciones infantiles, edificios gubernamentales, automóviles de pasajeros y aviones. Sin embargo, en la práctica, el uso de productos de tabaco calentado está permitido en otros lugares públicos como restaurantes, barcos y trenes de pasajeros. El impuesto sobre estos productos es actualmente equivalente al del tabaco para pipa según la Ley de Impuesto al Tabaco, y la venta a menores está restringida de acuerdo con el artículo 5 de la Ley de Prohibición de Fumar para Menores. Además, estos productos también están regulados por la Ley de Negocios del Tabaco.
