W Szwajcarii e-papierosy są legalne i podlegają regulacjom jako wyroby tytoniowe. Sprzedaż e-papierosów przez internet nie jest jednak dozwolona, a promowanie ich stosowania poprzez sugerowanie korzyści zdrowotnych jest zakazane. W przeciwieństwie do tradycyjnych papierosów, e-papierosy nie są objęte podatkiem akcyzowym. Szwajcaria posiada jasne ramy prawne dotyczące tych produktów – wymagane są opakowania zabezpieczone przed dziećmi i przypadkowym otwarciem, a na wszystkich opakowaniach muszą znajdować się ostrzeżenia zdrowotne. Nie ogranicza się gamy smaków, lecz maksymalne stężenie nikotyny w płynie wynosi 20 mg/ml, a pojemność zbiorników nie może przekraczać 2 ml. Używanie e-papierosów w miejscach publicznych podlega również ograniczeniom prawnym. Szacuje się, że w 2022 roku w Szwajcarii było około 221 000 aktualnych użytkowników e-papierosów. Odsetek dorosłych aktualnie korzystających z e-papierosów wynosił 3%. Wśród dorosłych obecnych użytkowników e-papierosów było 2,6% kobiet i 3,4% mężczyzn. Udział osób codziennie korzystających z e-papierosów wśród dorosłej populacji ocenia się na 1,7% ogółem, przy czym codzienne używanie zadeklarowało 1,7% kobiet i 1,8% mężczyzn.
