Palenie tytoniu jest dozwolone w Azerbejdżanie i podlega regulacjom jako produkt tytoniowy. Używanie, sprzedaż oraz kupno papierosów, także za pośrednictwem internetu, są legalne. Zabronione jest natomiast nabywanie papierosów z automatów sprzedających. Import papierosów w celach handlowych jest dopuszczalny wyłącznie na podstawie licencji. Na opakowaniach papierosów obowiązkowo muszą się znajdować ostrzeżenia zdrowotne, a minimalny wiek uprawniający do zakupu tych wyrobów to 18 lat. Dodatkowo obowiązują prawne ograniczenia dotyczące palenia w miejscach publicznych. Na produkty tytoniowe nakładany jest ogólny podatek akcyzowy w wysokości 50%. Według szacunków z 2022 roku liczba dorosłych palaczy w Azerbejdżanie wynosiła około 1,5 miliona, co stanowi 19,3% dorosłej populacji. Wśród mężczyzn odsetek ten wynosił 39,6%, a wśród kobiet 0,1%. Z danych z 2017 roku wynika, że liczba codziennych palaczy sięgała około 1,2 miliona, a codzienne palenie tytoniu deklarowało 16,3% dorosłych (33,2% mężczyzn i 0,2% kobiet). W 2021 roku palenie tytoniu przyczyniło się w Azerbejdżanie do szacunkowo 11,3 tysiąca zgonów, z czego 9,3 tysiąca dotyczyło mężczyzn, a 2 tysiące kobiet. Oznacza to, że palenie było przyczyną 12,6% wszystkich zgonów w kraju, w tym 18,81% zgonów mężczyzn i 4,91% zgonów kobiet w tym roku.
