W Serbii palenie tytoniu jest dozwolone i objęte pewnymi regulacjami. Sprzedaż i kupno papierosów są legalne, w tym sprzedaż internetowa, natomiast zakazany jest zakup z automatów. Import papierosów w celach handlowych jest możliwy wyłącznie na podstawie licencji importowej. Opakowania papierosów muszą zawierać ostrzeżenia zdrowotne, które mają informować konsumentów o zagrożeniach związanych z paleniem. Minimalny wiek uprawniający do zakupu wyrobów tytoniowych, w tym papierosów, wynosi 18 lat. Palenie jest prawnie ograniczone w miejscach publicznych, aby chronić osoby niepalące przed narażeniem na dym tytoniowy. Całkowity poziom opodatkowania papierosów w Serbii wynosi 75%. Według danych z 2022 roku liczba aktualnych palaczy w Serbii wynosiła około 2,7 miliona osób. Odsetek dorosłych obecnie palących wynosił 36,6%. Wśród dorosłych kobiet odsetek palących wynosił 34,6%, a wśród dorosłych mężczyzn – 38,8%. Statystyki wskazują także na istotny wpływ palenia na śmiertelność w Serbii. Większe obciążenie obserwuje się wśród mężczyzn, gdzie 16,3% wszystkich zgonów miało związek z paleniem, podczas gdy wśród kobiet było to 7,33%. Te dane podkreślają istotny wpływ palenia na stan zdrowia publicznego w Serbii.
