E-papierosy są legalne w Polsce i podlegają szczegółowym regulacjom. Zgodnie z tymi przepisami sprzedaż e-papierosów osobom niepełnoletnim, czyli poniżej 18. roku życia, jest zakazana, a wymagane są zgłoszenie produktu, opakowania zabezpieczające przed dziećmi oraz ostrzeżenia zdrowotne na opakowaniach. Nie obowiązują ograniczenia dotyczące smaków, natomiast zawartość nikotyny jest ograniczona do 20 mg/ml, a także obowiązują limity pojemności zbiornika. Używanie e-papierosów w miejscach publicznych podlega również odpowiednim ograniczeniom prawnym. E-papierosy można kupić zarówno przez internet, jak i w tradycyjnych punktach sprzedaży, jednak sprzedaż poprzez automaty jest niedozwolona. Zakazane jest składanie oświadczeń sugerujących właściwości prozdrowotne oraz obowiązuje całkowity zakaz reklamy. Na e-papierosy nałożona jest akcyza, która wynosi 10% stawki stosowanej wobec tradycyjnych papierosów. W 2023 roku w Polsce odnotowano około 1,3 miliona aktualnych użytkowników e-papierosów, a rozpowszechnienie ich używania wśród dorosłych wyniosło 4%. Codzienne stosowanie e-papierosów przez dorosłych odnotowano na poziomie 2,4% w tym samym roku; w przypadku mężczyzn odsetek ten wyniósł 0,4%, a wśród kobiet – 1,5%. Dla porównania, w 2017 roku 13% osób zadeklarowało, że kiedykolwiek próbowało e-papierosów. Jeśli chodzi o postrzeganie ryzyka związanego z e-papierosami, w 2017 roku 56% osób uważało, że e-papierosy są tak samo lub bardziej szkodliwe niż papierosy tradycyjne, 28% było zdania, że są mniej szkodliwe, a 16% nie miało na ten temat zdania.
