W Hiszpanii podgrzewane wyroby tytoniowe są regulowane jako nowe produkty tytoniowe na mocy Real Decreto 579/2017. W związku z tym obowiązuje także ustawa 28/2005 o środkach zdrowotnych przeciwko paleniu tytoniu oraz regulacji sprzedaży, dostaw, konsumpcji i reklamy wyrobów tytoniowych, która ogranicza sprzedaż, reklamę, promocję i sponsoring, a także używanie tych produktów w miejscach publicznych.
