E-papierosy są legalne w Belgii na mocy określonych przepisów. Dozwolona jest ich sprzedaż i używanie, jednak sprzedaż internetowa jest zabroniona. Można przedstawiać oświadczenia dotyczące zdrowia, ale obowiązuje zakaz wszelkiej reklamy. E-papierosy są dostępne w sprzedaży ogólnodostępnej, a na te produkty nie jest nakładana akcyza. Przepisy wymagają zgłaszania nowych produktów, stosowania opakowań zabezpieczonych przed dziećmi i niedozwolonym otwarciem oraz zamieszczania ostrzeżeń zdrowotnych na opakowaniach. Sprzedaż jest ograniczona do osób powyżej 18. roku życia, a używanie e-papierosów podlega ograniczeniom prawnym w miejscach publicznych. Zawartość nikotyny nie może przekraczać 20 mg/ml, a pojemność zbiornika – 2 ml. Nie obowiązują natomiast ograniczenia co do wyboru smaków. Jeśli chodzi o rozpowszechnienie, w Belgii w 2023 roku było około 383 900 obecnych użytkowników e-papierosów, co odpowiada 4% dorosłych korzystających z e-papierosów na bieżąco. Odsetek ten był wyższy wśród mężczyzn (12%) niż kobiet (8%). W tym samym roku codzienne używanie e-papierosów wśród dorosłych wynosiło ogółem 1,2%. W 2021 roku odsetek ten wynosił 3% zarówno wśród mężczyzn, jak i kobiet. Dla porównania, w 2017 roku 16% dorosłych zadeklarowało, że kiedykolwiek próbowało e-papierosów. W badaniu przeprowadzonym w 2017 roku 62% respondentów w Belgii uznało, że e-papierosy są szkodliwe lub bardziej szkodliwe niż papierosy, 34% uważało je za nieszkodliwe lub mniej szkodliwe, a 4% nie miało zdania.
