Ustawa nr 37/2007 wdraża artykuł 19 dyrektywy UE w sprawie wyrobów tytoniowych, który obejmuje nowe wyroby tytoniowe i ma zastosowanie do podgrzewanych wyrobów tytoniowych. Przepisy regulują wymogi dotyczące sprawozdawczości, zgłoszeń oraz oznaczeń ostrzegawczych o szkodliwości zdrowotnej. Podgrzewane wyroby tytoniowe objęte są podatkiem akcyzowym od wyrobów tytoniowych w takiej samej wysokości jak wyroby tytoniowe przeznaczone do palenia. Dodatkowo nakładany jest podatek ad valorem w wysokości 15% oraz podatek w wysokości 0,080 euro za gram tytoniu.
