We Włoszech e-papierosy są legalne i objęte regulacjami. Można je kupować zarówno przez internet, jak i w specjalistycznych sklepach stacjonarnych. Oświadczenia dotyczące wpływu e-papierosów na zdrowie są dozwolone, pod warunkiem spełnienia wymagań prawnych, natomiast wszelka reklama i działania promocyjne są całkowicie zakazane. Produkty tego typu objęte są również podatkiem akcyzowym w wysokości 10% stawki stosowanej wobec tradycyjnych papierosów. We Włoszech funkcjonuje kompleksowy system regulacji dotyczący wytwarzania i sprzedaży e-papierosów. Zgodnie z tymi przepisami firmy mają obowiązek zgłaszania organom nadzoru każdego nowego produktu przed wprowadzeniem go na rynek. Wszystkie opakowania muszą zawierać wyraźne ostrzeżenia zdrowotne oraz wykorzystywać pojemniki zabezpieczone przed dziećmi i nieuprawnionym otwarciem. Ponadto sprzedaż dozwolona jest wyłącznie osobom powyżej 18. roku życia. Stężenie nikotyny w płynach nie może przekraczać 20 mg/ml, a pojemność zbiorników jest ograniczona do 2 ml lub mniej, zgodnie z wymogami Unii Europejskiej. Nie ma ograniczeń dotyczących smaków, jednak używanie e-papierosów jest zabronione w niektórych miejscach publicznych. W 2023 roku szacowano, że we Włoszech 1,6 miliona osób aktualnie używało e-papierosów. Udział dorosłych obecnie korzystających z e-papierosów wyniósł 3%, natomiast odsetek dorosłych codziennie używających tych urządzeń oszacowano na 1,5%. Dane z badania opinii publicznej przeprowadzonego w 2017 roku pokazały, że 46% Włochów uważało, że e-papierosy nie są szkodliwe lub są mniej szkodliwe od tradycyjnych papierosów, 34% uznało je za szkodliwe lub bardziej szkodliwe, a 20% nie miało w tej sprawie zdania.
