We Francji artykuł 19 unijnej dyrektywy dotyczącej wyrobów tytoniowych, odnoszący się do nowatorskich wyrobów tytoniowych, obejmuje również podgrzewane wyroby tytoniowe. Przepisy regulują obowiązki sprawozdawcze, zgłoszeniowe oraz umieszczanie ostrzeżeń zdrowotnych. Dodatkowo, Francja opodatkowuje podgrzewane wyroby tytoniowe w ramach kategorii „autres tabacs à fumer” („inne wyroby tytoniowe do palenia”).
