Los cigarrillos electrónicos son legales en Nueva Zelanda y están sujetos a regulaciones que abarcan la seguridad del producto, el etiquetado y la venta. Según estas normas, los nuevos productos deben ser notificados antes de ingresar al mercado y los envases deben ser a prueba de niños. Es obligatorio incluir advertencias sanitarias en el empaque, y la venta está restringida a personas mayores de 18 años. También existen límites en la concentración de nicotina (no superior a 20 mg/ml), pero no hay restricciones en cuanto a la variedad de sabores. El uso de cigarrillos electrónicos en espacios públicos también está regulado. Estos dispositivos pueden comprarse legalmente por internet y están disponibles en comercios generales. Se permiten declaraciones de salud sobre los cigarrillos electrónicos y, actualmente, no se aplica impuesto especial a estos productos. En 2021, se estimó que 316,500 personas en Nueva Zelanda eran usuarias actuales de cigarrillos electrónicos. En 2023, la prevalencia de uso actual en adultos se calculó en 11.9%, siendo del 7% en mujeres y del 9.5% en hombres. El número de usuarios diarios fue de 239,300, con una prevalencia diaria en adultos del 6.2% (5% en mujeres y 7.5% en hombres). En una encuesta realizada en 2021 en el país, el 25.2% de los encuestados afirmó haber probado cigarrillos electrónicos.
